Acceptable Use Policy

Please read it carefully. It is a condition of your use of our service that you comply with the terms of this Policy. Please look out for any amendments to the Policy that Diggy might make in the future.

This policy is here to protect users of our network and outlines the rules and guidelines for using our network. This document may be referred to in other documents as the "Acceptable Use Policy". By outlining the terms of use and enforcing them all clients should be able to enjoy optimum use of our services.

This policy is applicable to all Diggy's customers. A breach of any of the terms and conditions of this policy by any customer is strictly prohibited and may lead to the suspension or termination of the customer's service, without notice.

If you permit others to use our service, you are responsible for making users of the service aware of this policy and obtaining compliance of your users with this policy.

The following behaviours are unacceptable uses of the Internet and the Network:

1. SPAM
including sending or causing the sending of any unsolicited or unauthorised advertising, promotional materials, junk mail, bulk unsolicited email, mail bombing, chain letters, multiple newsgroup cross-posting, or other form of solicitation;

2. BENEFITING FROM SPAM
including hosting any Web site which, on a regular basis, is advertised by any person sending unsolicited commercial email or unsolicited bulk email or spam;

3. EMPLOYING IDENTITY-DISGUISING TECHNIQUES IN CONNECTION WITH SPAM
including relaying email via a third party's mail server without permission, hosting an open mail relay server, or employing similar techniques to hide or obscure the source of an email;

4. BREACHING INTELLECTUAL PROPERTY RIGHTS
including hosting any content which infringes any copyright, trademark, trade secret, patent or other property or other intellectual property rights of any third party unless you are the owner of, or have the permission of the owner to post or transmit the content;

5. SPREADING VIRUSES
including knowingly hosting or transmitting any content that contains any software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

6. HOSTING CONTENT WHICH IS UNLAWFUL/CRIMINAL
including hosting or transmitting any content the hosting or transmitting of which would be a contravention of any law of the Commonwealth of, or a State in, Australia, such as, for example, material of a pornographic nature depicting children; and

7. MALICIOUS ACTIVITY AGAINST OTHER HOSTS ON THE Internet
including:
(i) defacing of Web-sites without the permission of the Web site owner;
(ii) obtaining (or attempting to obtain) un-authorised access to data by circumventing (or attempting to circumvent) security controls designed to prevent un-authorised access;
(iii) the use of "probing" of devices on the Internet with the intent of searching for and/or identifying security weaknesses on those devices
(iv) interference with service to any user, host or network including, without limitation, mailbombing, flooding, deliberate attempts to overload a system and broadcast attacks and denial of service attacks.

Users of unlimited ADSL plans may be restricted to 64Kbps download speeds if they exceed the maximum download thresholds. This restriction only applies until the end of the month in which the specified download threshold is exceeded.

Diggy requires you to take responsibility for maintaining the security of your service. Protection of the security aspects of your service, like accounts and passwords, are your responsibility. Subsequent usage of your service by a third party will result in you being responsible for the charges incurred.

You must not use, or allow any other person to use, the FutureWeb network and systems for any activities of an illegal or fraudulent nature, including any activities prohibited under the Telecommunications Act 1989 (Cth) or under other applicable state and/or Commonwealth Laws.

Diggy reserves the right to suspend or terminate your service without refund should you or your customers breach, or assist, abet encourage or incite another party to breach, any of the above terms, conditions, rules, regulations or laws.

Diggy disclaims all liability for, and does not accept any responsibility for, anything that may happen to you or your equipment, or any loss incurred by you through use of Diggy services or the suspension or termination of your service by Diggy.
